working days
The notion of working days means that the days are counted from Monday to Saturday .
Note: public holidays are not working days.
For the calculation of paid leave in working days, the employee is entitled to 30 days of leave per year, counted from Monday to Saturday.
For example: An employee wishes to take a full week of paid vacation, the company deducts 6 days of vacation for him.
Working days
Working days are the days normally worked in the company : Monday to Friday, Tuesday to Saturday, etc.
For the calculation of paid leave in working days , the employee is entitled to 25 days of leave per year, deducted from the days normally worked.
For example: Business days in the company are Monday to Friday. An employee who takes his leave from Monday to Friday will be deducted 5 days of paid leave.
Holidays
Non-working days are non-working days. By extension, paid holidays are also non-working days.
As a general rule, Sunday is the day off and therefore not worked.
May 1 is the only day off and paid for all employees , except for exceptions such as the personnel of certain services (emergency services for example). Article L3133-6 of the labor code even provides that employees who work in a sector where work cannot be interrupted are paid double on May 1.
Note: public holidays are not necessarily non-working days. In certain professions or in certain sectors of activity, employees may therefore be called upon to work (in public transport, for example). It is important to find out about public holidays in the employment contract or the collective agreement.
Holidays
Public holidays are legal holidays listed in article L. 3133-1 of the labor code :
- January 1st
- Easter Monday (variable)
- The 1st from
- The 8 from
- L’Ascension (variable)
- Whit Monday (solidarity day since 2003)
- The 14th of July
- The Assumption (August 15)
- All Saints Day (November 1)
- November 11th
- Christmas Day (December 25)
Public holidays are paid for all employees from 3 months of seniority in the company ( article L3133-3 of the labor code ). The salary and its accessories are therefore maintained in full. If a public holiday is worked , it is paid on the basis of normal remuneration , except for a different provision in the collective agreement.
Public holidays are not counted for the calculation of paid leave.
Namely: The same rules are applied to employees on fixed-term or permanent contracts . A part- time employee is remunerated according to the number of hours he would have had to work if the day had not been a public holiday.
